1. General Provisions

(1) These General Terms and Conditions (GTC) apply to all contracts that you conclude with us as a provider (Alexander Ehrlichmann) via the website [lust4sin.com]. Unless otherwise agreed, the inclusion of any of your own conditions is hereby objected to.

(2) A consumer in the sense of the following provisions is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or a legally competent partnership that acts in the exercise of its self-employed professional or commercial activity when concluding a legal transaction.

(3) All deliveries and services provided by us within the framework of contracts concluded via the online shop under the Internet domain [lust4sin.com] are exclusively based on the following GTC in the version valid at the time of the order.

(4) Individual contractual agreements take precedence over these General Terms and Conditions. Deviating, conflicting, or supplementary General Terms and Conditions do not become part of the contract unless their validity is expressly agreed upon.

(5) The delivery area and thus the scope of these GTC is the Federal Republic of Germany. Deliveries outside Germany will only take place after individual agreement.

2. Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By placing the respective products on our website, we make you a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the item description.

(3) The contract is concluded via the online shopping cart system as follows:

  • The goods intended for purchase are placed in the "shopping cart." You can call up the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time.
  • After entering your personal data and the payment and shipping conditions and clicking the "Check order" button, the order data will be displayed as an order overview.
  • Before submitting the order, you have the option to check the information in the order overview again, change it (also via the "back" function of the Internet browser), or cancel the order.
  • By submitting the order via the corresponding "Pay now" button, you legally declare acceptance of the offer. The purchase contract is concluded as soon as we confirm your order by email after receiving it.

(4) The order processing and transmission of all information required in connection with the conclusion of the contract is partly automated by email. You must, therefore, ensure that the email address you have provided to us is correct, that the receipt of emails is technically ensured, and, in particular, that it is not prevented by SPAM filters.

3. Right of Withdrawal

(1) Consumers generally have a right of withdrawal.

(2) We accept returns within 14 days from the date of receipt of the goods. The return is free of charge for you, and no restocking fee is charged. Please note that sale items are excluded from returns.

Right of Withdrawal Instruction

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party named by you who is not the carrier has taken possession of the last goods.

To meet the withdrawal deadline, it is sufficient for you to send the communication regarding your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we must reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we were informed of your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement.

We may refuse to make the reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and, in any case, no later than fourteen days from the day on which you informed us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties, and functioning.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to distance contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

4. Prices and Shipping Costs

(1) The prices listed on the product pages include the statutory value-added tax (VAT) and other price components.

(2) In addition to the prices stated, we charge shipping costs for delivery, which are not included in the purchase price. They can be accessed via a corresponding button on our website or in the respective offer, are shown separately during the ordering process, and must be paid by you additionally, unless free delivery is promised.

(3) There is no minimum order value.

5. Delivery Conditions

(1) Delivery is made within Germany and the EU.

(2) The delivery time for in-stock items is 3-10 business days for Germany and EU countries. We will inform you of any deviations in delivery times for individual items on the respective product page.

(3) For goods that are not in stock and are shipped directly from the manufacturer, the delivery time is usually 10 to 15 days. This shipment is mainly carried out by courier services such as UPS and FedEx. The buyer can easily track the progress of the shipment via the website 17track.net.

(4) The exact shipping costs will be displayed during the ordering process and depend on the weight of the ordered goods and the chosen shipping method.

(5) Age verification upon delivery: The supplier undertakes to ensure that the age verification of the recipient is carried out by the delivery service when the goods are delivered. The delivery service may only hand over the goods to persons who have reached the statutory minimum age and can prove this by presenting a valid ID document.

(6) The seller is responsible for customs clearance and any customs duties. These costs are included in the shipping costs.

6. Payment Terms

(1) Payment can be made by the following methods:

7. Retention of Title

The goods remain our property until full payment has been made.

8. Warranty and Liability for Defects

8.1 Statutory Defect Liability Rights

(1) The statutory defect liability rights apply, which are explained in more detail below.

(2) We would like to point out that our products are hygiene items. For this reason, returns and refunds of the goods after the seal has been broken are excluded unless there is a defect that already existed at the time of delivery. Defects that may occur include, for example:

  • Material defects (e.g., cracks in the silicone or TPE)
  • Manufacturing defects (e.g., loose or defective joints)
  • Functional defects (e.g., faulty mechanics)

(3) If such a defect already exists upon delivery, you have the statutory right to subsequent performance. This means that you must first give us the opportunity to remedy the defect through repair or provide a replacement. If the subsequent performance fails, you can reduce the purchase price or withdraw from the contract according to the statutory provisions.

8.2 Exclusion of Warranty

(1) The warranty is excluded if the defect was caused by improper use, misuse, or normal wear and tear. In particular, sex dolls that have been opened and used after delivery cannot be returned for hygiene reasons unless a defect already existed at the time of delivery.

(2) If the seal was removed after delivery, we cannot accept the return of the doll for reasons of health protection and hygiene unless a defect already existed at the time of delivery and was not caused by use.

(3) A return of the goods after the expiry of the statutory warranty period is generally excluded.

9. Youth Protection

(1) When selling goods that are subject to the provisions of the Youth Protection Act, we only enter into contractual relationships with customers who have reached the statutory minimum age. Existing age restrictions are indicated in the respective product description.

(2) By submitting your order, you confirm that you have reached the statutory minimum age and that the information you provided regarding your name and address is correct. An age verification is carried out during the ordering process. We use a two-step verification process for this purpose:

  1. First age verification: The age of the buyer is already checked electronically during the order process to ensure that the buyer has reached the statutory minimum age.
  2. Second age verification upon delivery: Upon delivery of the goods, the person receiving the delivery must also have reached the required minimum age. The logistics service provider is instructed to hand over the goods only to the adult buyer. A valid ID document must be presented to confirm the age.

(3) If delivery is made to an address other than the one provided in the order, the receiving person must also be able to provide proof of the statutory minimum age. If the receiving person is unable to provide proof of age, the goods will not be handed over.

(4) If we are required by law to carry out age verification, we instruct the logistics service provider responsible for delivery to hand over the goods only to persons who have reached the statutory minimum age and, in case of doubt, to request the ID card of the person receiving the goods for age verification.

(5) If we indicate in the respective product description that you must be 18 years of age or older to purchase the goods, paragraphs 1-4 above apply with the proviso that instead of the statutory minimum age, adulthood must be reached.

10. Battery Law Notice

Batteries and accumulators may not be disposed of with household waste. You are legally obligated to return used batteries and accumulators. Used batteries may contain harmful substances that can harm the environment or your health if improperly stored or disposed of. However, batteries also contain important raw materials, such as iron, zinc, manganese, or nickel, and can be recycled. You can return the batteries to us after use or return them free of charge in your immediate vicinity (e.g., in stores, municipal collection points, or at our shipping warehouse).

The symbol of the crossed-out wheeled bin means that you must not dispose of batteries and accumulators in household waste:

  • Pb = battery contains lead
  • Cd = battery contains cadmium
  • Hg = battery contains mercury

11. Usage Rights and Copyright

The content and works created by the site operators on these pages are subject to German copyright law. Contributions by third parties are marked as such. The reproduction, editing, distribution, and any kind of use outside the limits of copyright require the written consent of the respective author or creator. Downloads and copies of this site are only permitted for private, non-commercial use.

12. Disclaimer of Liability

(1) We are only liable for intent and gross negligence. In cases where an attributable breach of duty is based on simple negligence and a material contractual obligation (obligations whose fulfillment makes the proper execution of the contract possible in the first place, whose violation endangers the achievement of the contractual purpose, and on whose compliance you regularly rely as a customer) is culpably violated, our liability for damages is limited to the foreseeable damage that typically occurs in similar cases.

(2) Liability under the provisions of the Product Liability Act remains unaffected. Otherwise, liability is excluded.

13. Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. Consumers have the opportunity to use this platform to settle their disputes.

(2) We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

Delivery will be made no later than one working day (Monday to Friday, excluding public holidays) after the conclusion of the contract or receipt of the order when paying via PayPal, credit card.
